PRIVACY POLICY AGREEMENT

Smarte Offline by Green Forest, represented by Ruslan Dmytrovych Nyinnyk, acting under the Charter (hereinafter referred to as the "Company"), on one side, and the User of the Website and Mobile application (hereinafter also referred to as the "User"), who has accepted and agrees to the terms of this "Agreement on the Processing of Personal Data and the Website Privacy Policy" (hereinafter referred to as the "Agreement"), by joining the User to the terms of this Agreement in the manner prescribed by this Agreement, the terms of which provide the following:

1. General Provisions
1.1. This Agreement has been developed in accordance with the requirements of the Law of Ukraine "On the Protection of Personal Data" and other regulatory acts of Ukrainian legislation that govern legal relations related to the collection, processing, and storage of personal data, as well as the rights of citizens to privacy and self-expression. This Agreement is a public contract of adhesion.
1.2. The User of the Website and Mobile application, when visiting the resources of this site, confirms their agreement with the rules and requirements of the Agreement. If the User does not agree to the terms of the Agreement, they are obliged to leave the site and refrain from visiting it in the future.
1.3. The procedure for granting consent includes:
1.3.1. the use of any of the functions or services of the Website and Mobile application;
1.3.2. registration on the Website (including through accounts on other networks);
1.3.3. providing their data in the fields "Your Name" and mobile phone.
1.3.4. indicating and/or checking "I agree with the Agreement on the Processing of Personal Data" when using the services of the Website and Mobile application.
1.4. The User of the Website and Mobile applicationhas no right to post information or use the site if they do not agree with the Privacy Policy, have not reached the legally established age to enter into agreements, are restricted in their rights according to the law, or are not an authorized person of the company on behalf of which the information is posted.
1.5. The storage of the personal data of the User of the Website and Mobile application will be conducted by Green Forest at the following address: Kyiv, Dragomyriv St., 3, Apt. 3.
1.6. This Agreement is effective from September 15, 2018, and will be updated as necessary and/or as a result of changes in current legislation.

2. Terms and Definitions
“Database” - a collection of information (data) in computer files and Database Management System.
“Information (data) of the Website and Mobile application” - information about the services of the Website, which Users enter into the database.
“Information” - any data, texts, links, graphic, video, and audio objects, Materials.
“User” (or “Users”) - any individual/legal entity (or programs allowing the use of the site – “Bots”), regardless of legal status and capacity, who utilize any functions or services of the Website and Mobile application..
“Company” - the owner of the Website – Green Forest, represented by Ruslan Dmytrovych Nylyk, address: Kyiv, Dragomyriv St., 3, Apt. 3, EDRPOU code 36186875.
“Materials” - text information (data), photographs, graphics, messages, audio (video) recordings, program codes, comments, and other materials.
“Registration on the Website” (hereinafter also “Registration”) - the process of providing personal data to the Website to gain access to additional services or resources that cannot be accessed by unregistered Users.
“Website” - https://greenforest.com.ua/ and all its elements/sections/parts/web pages located at the specified link.
“Mobile application” - Smarte Offline, an app that provides Green Forest students with offline access to theinteractive textbook “Notes”, saves their progress, and synchronizes it once connected to the network.

3. Restrictions According to the Privacy Policy
3.1. The User of the Website and Mobile application must adhere to the following rules:
3.1.1. not to use the site improperly, not to attempt to influence or interfere with its operation, or gain access to information other than through the standard interface;
3.1.2. to use the site only in accordance with Ukrainian legislation;
3.1.3. in case of violation of the terms of the Agreement or if there is suspicion of violation of the terms of the Agreement, the Administrator has the right to suspend or completely deny the User access to the website based on the User’s IP address.
3.2. The Company may review this Agreement at any time and update it. The User has an obligation to stay informed about these changes and should visit this page from time to time to review the current version of the Agreement.

4. Rights of the User of the Website and Mobile application
4.1. The User of the Website and Mobile application has the right to:
4.1.1. know the location of the database containing their personal data, its purpose and name, location, and/or residence (stay) of the owner or manager of the personal data or to give appropriate instructions for obtaining this information to authorized persons, except as provided by law;
4.1.2. receive information about the conditions for granting access to personal data, including information about third parties to whom their personal data is transmitted;
4.1.3. access their personal data;
4.1.4. receive a response regarding whether their personal data is stored in the relevant database no later than thirty calendar days from the date of request, except in cases provided by law, as well as obtain the content of their personal data stored;
4.1.5. submit a reasoned demand to the owner of personal data to object to the processing of their personal data;
4.1.6. submit a reasoned demand for the modification or destruction of their personal data by any owner and manager of personal data if such data is processed illegally or is inaccurate;
4.1.7. protect their personal data from illegal processing and accidental loss, destruction, damage, due to intentional concealment, non-provision, or untimely provision, as well as to protect against the provision of information that is inaccurate or defames the honor, dignity, and business reputation of an individual;
4.1.8. file complaints about the processing of their personal data with government authorities and officials responsible for ensuring the protection of personal data, or to court;
4.1.9. apply legal remedies in case of violations of the legislation on the protection of personal data;
4.1.10. make reservations regarding the limitation of the right to process their personal data when giving consent;
4.1.11. withdraw consent to the processing of personal data;
4.1.12. know the mechanism of automated processing of personal data;
4.1.13. protection against automated decisions that have legal consequences for them.
4.2. The management of personal data of the User of the Website, who is restricted in civil capacity or recognized as incapacitated, is carried out by their legal representative.

5. Purposes of Collecting Personal Data
5.1. The Company collects and uses the personal data of the User of the Website to better provide necessary services and information, as well as to:
5.1.1. respond to questions and requests;
5.1.2. process orders;
5.1.3. fulfill its obligations under any contract concluded with the Company;
5.1.4. prevent and resolve problems related to any services provided to the User;
5.1.5. create products or services that meet the needs of the User;
5.1.6. promptly respond to potential complaints regarding deficiencies in the services provided.
5.2. The Company may use personal data in direct marketing (including providing information about products and services that may be of interest in the future via SMS, emails, or VIBER).
5.3. Except as provided in this privacy policy, the Company will not disclose any personal information unless required by law or if such action is necessary to protect or prevent a violation of our rights, property, or personal safety, as well as regarding our users/customers and others.

6. Use of Personal Information Provided on Other Sites
6.1. The Company’s website may contain links to other websites, or the User may navigate to the Company’s website via links from other sites.
6.2. The Company is not responsible for the privacy policy and practices on other sites.

7. Cookie Policy, Use of Google Analytics
7.1. The Company uses cookies while operating the site. These cookies allow the identification of the browsers of users who visit our site repeatedly, and they may store user settings and other information. For user convenience, the Company uses a remarketing function. Cookies are also used with this function.
7.2. The User can configure their browser to reject all cookies or notify them of their sending.
7.3. The Company collects statistics about site visits through Google Analytics, such as visited pages, number of page views, domains, Internet service providers, and countries of origin of our visitors, as well as the addresses of sites visited before and after our site, etc.

8. Other Provisions
8.1. The Company takes measures to ensure that the information on this site is accurate. However, the Company does not assume responsibility and does not guarantee that the provided information and data are accurate, objective, and current at the time of viewing.
8.2. It is prohibited to distribute, modify, transmit, use, or reuse any information from this site for any public or commercial purpose without the written permission of the Company.
8.3. Users may change/delete personal information (phone) or opt out of subscriptions at any time. The functionality of some Company services that require user information may be suspended upon changing/deleting the information (including paid services).
8.4. The personal data of the User is stored until it is deleted by the User. Sufficient notification to the User about the deletion or other processing of personal data will be a letter (information) sent to the email provided by the User. If the User does not provide their own email address, no notification will be sent to the User.
8.5. The User agrees to the Agreement, as well as to the transfer and processing of their data. The User confirms their adulthood and the absence of any acts that limit their capacity.
8.6. The User of the Website and Mobile application has the right to personally inquire about the information held by the Company and make corrections if necessary. The User has the right to ask us not to use their information by not providing consent in the registration form. If the User has additional questions that are not disclosed in this Agreement, they may send a letter to: Kyiv, Dragomyriv St., 3, Apt. 3.
